If you search for a kauai business license hawaii, you will find that Hawaii does not issue a general business license at the state or county level. Kauai County covers Kauai and Niihau, home to 73,400 people according to the 2025 Census estimate, and operating legally here means completing a short list of separate items. Some are filings with the state, some are tax registrations, and some are permits from a specific agency or county department. This guide covers each one in the order most owners reach them.

This article is informational, not legal or tax advice. Confirm every figure with the agency named before you pay, because fees and rules change.

What 'business license' means on Kauai

Registering an entity or a trade name is a filing, not a license. Hawaii licenses by agency or by trade. The DCCA Professional and Vocational Licensing boards cover many professions, the Department of Health issues food permits because Hawaii has no county health department, county liquor commissions issue liquor licenses, and county planning departments control where and how vacation rentals may operate. The one universal state registration is the General Excise Tax (GET) license.

Materials and information to gather first

  • Your entity name, checked free in the BREG business name search at https://hbe.dcca.hawaii.gov/search-and-buy. An LLC name must include Limited Liability Company, LLC or L.L.C., and it cannot be substantially identical to a name already registered.
  • A registered agent with a physical Hawaii street address. The agent must be an individual or an entity authorized to transact business in Hawaii, and an LLC cannot serve as its own agent.
  • A Hawaii Business Express (HBE) account at https://hbe.dcca.hawaii.gov/, the online portal the division describes as the most efficient filing method.
  • A payment method for each fee listed below, plus a cash reserve for unexpected county renewal costs.
  • For a vacation rental: the property's street address and confirmation from the Planning Department of whether it sits inside the Visitor Destination Area.
  • For a restaurant: a floor plan, a menu, and a projected split of food and beverage revenue.

Step 1: Register your LLC or corporation

Choose your entity type first. An LLC files Articles of Organization (Form LLC-1) with a $50 filing fee. A corporation files Articles of Incorporation (Form DC-1) with the same $50 filing fee. Hawaii does not charge a franchise tax on LLCs. Either entity must name a registered agent in its Articles, and the Articles must state the agent's complete Hawaii street address.

If you need time to settle on a name, a name reservation costs $10 and holds the name for 120 days.

A commercial registered agent files a listing statement with BREG for $100, and the provider will charge you for its service on top of that. A commercial agent solves the Hawaii address requirement, but weigh the ongoing cost against using an individual who is physically present in Hawaii.

Both LLCs and corporations file an annual report for $12.50. It is due by the end of the calendar quarter that matches your registration quarter, and no report is required in the year you register. An entity registered from July 1 to September 30 files by September 30. For example, an LLC registered in July 2026 files its first report by September 30, 2027. Confirm your due date in HBE after you file.

If you will operate under a name other than your legal entity name, register a trade name on Form T-1. The fee is $50 plus a $1 State Archives preservation fee. The registration is valid for five years, and the Department does not send renewal notices, so put the expiration date on your calendar. BREG has stated that expedited processing is not available right now, so do not plan around the optional $20 expedited fee. Hawaii has no county-level DBA filing.

Step 2: Get your General Excise Tax license

All persons doing business in Hawaii must obtain a GET license from the Department of Taxation. It is a one-time $20 fee. Apply on Form BB-1 or through Hawaii Tax Online at https://tax.hawaii.gov/. In-person applications are processed immediately, online applications through Hawaii Tax Online take 5 to 7 business days, and mailed applications take 4 to 6 weeks. The license stays active until you close it, surrender it or it is revoked.

Plan for the filing obligation that follows. Every license holder must file periodic and annual returns, even in a period with no income, so a slow quarter does not pause your duties.

Step 3: Apply the 0.5 percent county surcharge correctly

Hawaii has no sales tax. The GET is levied on your business's gross income or receipts, not on your customer, and the rate depends on the activity. Kauai has charged the 0.5 percent county surcharge since January 1, 2019, and all four counties have adopted it through December 31, 2030.

ActivityRate
Retail goods and services, rents, construction contracting and commissions4.5 percent (4.0 percent state plus 0.5 percent county surcharge)
Wholesaling and producing0.5 percent
Insurance commissions0.15 percent

If you visibly pass the tax on to customers, the maximum pass-on rate is 4.7120 percent. Keep your pricing and invoices consistent, and confirm with the Department of Taxation how your specific revenue is classified. Rental and lodging income may be treated differently from retail sales, so ask before you set your prices.

Step 4: Vacation rentals, the Visitor Destination Area and the $750 renewal

Transient vacation rentals are generally allowed only in the Visitor Destination Area, which includes places such as Kapaa, Princeville and Poipu. If your property sits outside that area, you need a nonconforming certificate, known as a TVNC, and it must be renewed every year. Do not assume that Maui or Honolulu short-term rental rules apply on Kauai, because the county's rules are its own.

The county's 2026 renewal form lists $750 per property. Most renewals are due by July 31, and there is no grace period, so a late renewal can leave the unit without a valid certificate. Fees and dates can change, so check the Kauai County Planning Department for current figures before you budget.

Add the county transient accommodations tax (TAT). The county TAT is 3 percent, effective October 1, 2021 under Ordinance 1099, which was signed September 16, 2021. The state transient accommodations tax is handled separately by the Department of Taxation, so confirm registration and filing schedules with both the state and the county Finance Department.

For property tax, the state's FY2026-27 report lists rates of 11.30, 11.75 and 12.20 per $1,000 for the Vacation Rental classification. The report does not tell you which rate applies to your parcel, so confirm that with the county Finance Department before you estimate your bill.

Step 5: Restaurant liquor license for a Class 2 general license

Apply through the county liquor control office. The application costs $100 plus a $5 online fee. A Class 2 restaurant general license costs $480 a year. That license requires at least 35 percent of gross revenue from food, so set up your point-of-sale reports to separate food and beverage sales from the start. Liquor licenses expire June 30, so calendar your renewal well before that date.

A restaurant also needs a food permit from the Department of Health and a GET license from the Department of Taxation. Apply for those in parallel so that your opening date is not held up by one agency.

Step 6: Food permits, peddlers and food trucks

Because Hawaii has no county health department, food safety permits come from the state Department of Health. Ask the Department of Health which permit fits your operation before you buy equipment. For a peddler or food truck license on Kauai, check with the county Finance and Planning departments. Do not assume the requirements or fees, and confirm both before you buy a vehicle.

Step 7: Hiring employees

If you hire, you must follow the Prepaid Health Care Act. Confirm your obligations with the state before your first payroll, so that your compliance plan is in place before you need it.

Tips and common mistakes

  • Looking for a county business license. None exists. Your work is the state entity registration, the GET license, and any permits your trade requires from a specific agency.
  • Getting the name wrong. An LLC name must include Limited Liability Company, LLC or L.L.C. Limited may be abbreviated as Ltd. and Company as Co.
  • Forgetting the annual report. Put the quarter-end deadline on your calendar as soon as you register, starting the year after registration.
  • Using an agent outside Hawaii. The agent must be physically present in the State, and an LLC cannot be its own agent.
  • Renting outside the Visitor Destination Area without a TVNC. Confirm your parcel's location with Planning before you list the property.
  • Missing the July 31 renewal. There is no grace period, so renew early.
  • Planning around expedited processing. BREG states that expedited processing is not available right now, following the July 6, 2026 move to its new registration system.
  • Falling short of the food rule. A Class 2 license requires at least 35 percent of gross revenue from food.
  • Assuming enterprise zone benefits. Kauai has four enterprise zones, which may offer priority permit processing, but ask whether your site qualifies before you count on it.

What to expect after you complete these steps

When these steps are complete, you may have your entity on file, a GET license in your name, and a calendar of recurring deadlines covering the annual report, GET returns, the July 31 vacation rental renewal and the June 30 liquor license expiration. Complete applications may reduce follow-up requests from agencies. BREG does not publish a standard turnaround time, so plan for routine processing rather than a fixed date, and expect results to vary with your trade, your location and each agency's current workload.
